Committee on Oversight and Investigations

This bill would require the Department of Investigation and the NYPD Inspector General to investigate allegations of misconduct that impugns the integrity of the criminal court system.

This bill would require the Commissioner of the New York City Department of Investigation (DOI) to conduct an ongoing investigation into the Fire Department’s (FDNY) compliance with federal, state, and local laws and policies relating to discrimination, harassment, and equal employment opportunity. DOI would be specifically required to examine how FDNY awards promotions and special assignments, how it handles complaints, and retaliation against complainants. DOI would also be required to provide a website that allows individuals to provide information relevant to this investigation. Finally, DOI would be required to regularly report their findings and recommendations to the mayor and the Council.

This bill would require the creation of impact and use policies regarding surveillance technologies used by the Fire Department, Office of Emergency Management, Department of Finance, Department of Investigation, Department of Correction, and Department of Probation. The policies would include information on surveillance technologies such as the description and capabilities, rules, process and guidelines, and any safeguards and security measures designed to protect the information collected. They would also include specific information on how facial recognition technology is used. Upon publication of a draft impact and use policy, the public would have a period of time to submit comments. The head of the agency publishing a policy would have to consider the comments and publish a final version of the policy. The bill would also prohibit the Police Department from using data obtained using surveillance technologies from the Fire Department, Office of Emergency Management, Department of Finance, Department of Investigation, Department of Correction, and Department of Probation when using that data would violate an impact and use policy of the Police Department.

This bill would require the commissioner of the department of investigation to appoint a special inspector of cybersecurity with the power and duties to investigate any city agency security breaches; assist and ensure compliance with security breach notification requirements; refer cyberattacks or incidents of a security breach to law enforcement agencies, and submit to the mayor and speaker of the council an annual report on cyberattacks or incidents of a data breach.
